Rule 23
Environmental impact study or assessment required
(1) According to the nature of a project, if the environmental impact study or environmental impact assessment of such project is required for the implementation of such project, the relevant investor shall conduct the environmental impact study or environmental impact assessment of such project within the period of sub-section (12) of Section 10 of the Act from the date of receiving the information that the project investment has been approved. Impact assessment should be done. Explanation: For the purpose of this rule, "Environmental Impact Study" and "Environmental Impact Assessment" mean "Preliminary Environmental Assessment" and "Environmental Impact Assessment" respectively as per the Environment Protection Rules, 2054.
(2) In accordance with sub-rule (1) of any project under Section 9 of the Act, the area determination and work list shall not be approved when carrying out environmental impact study or environmental impact assessment and the environmental impact assessment process and approval process shall be in accordance with Sub-Section (12) of Section 10 of the Act and this It will be as mentioned in the regulations.
(3) The content and format of the environmental impact study or environmental impact assessment report to be conducted in accordance with sub-rule (1) shall be as per schedule (4).
(4) When submitting the report according to sub-rule (3), the member of the team preparing such report must attach the declaration made in the format according to Schedule (5) to the report.
(5) While preparing the report according to sub-rule (1), the procedure according to the Environmental Protection Regulations, 2054 shall be adopted in matters other than those written in the Act and these Regulations.
(6) Thirteen copies of the report prepared in accordance with sub-rule (3) or (4) shall be submitted to the office, and the office shall carry out the necessary investigation on the report and, if it needs to understand anything or take an opinion from any body, it shall also take that opinion or suggestion and its recommendation. Twelve copies of the report will be sent to the Ministry of Environment for approval (7) The law in force when submitting an environmental impact study or impact assessment report under sub-rule (6).If there is any other thing to be included according to this, the office should also send it.
(8) After studying and discussing the environmental impact study or impact assessment report received in accordance with sub-rule (6), the Ministry of Environment shall establish an environmental expert committee as mentioned in Schedule 6 and take the opinion or suggestion on the report and determine the terms of reference of that committee. ) will determine.
(9) According to sub-rule (8), when studying or discussing the environmental impact study or impact assessment report, the investor or his consultant on his behalf shall make a presentation at the meeting of the environmental expert committee regarding the basic matters mentioned in the environmental impact study or impact assessment report.
(10) The committee according to sub-rule (8) shall study and discuss the environmental impact study or impact assessment report and recommend approval or rejection of the received report along with its opinion or suggestion.
(11) The Ministry of Environment shall inform the investor (proposer) to modify the report within five days based on the opinion or suggestion of the environmental expert committee, upon recommendation according to sub-rule (10), and the investor shall also modify and submit the report submitted by him within that period.
(12) According to sub-rule (11), if the environmental impact study or impact assessment report is submitted after modification, the Ministry of Environment shall approve the report with or without conditions, taking into consideration the recommendations or suggestions of the environmental expert committee.
(13) The members of the Environmental Expert Committee as per sub-rule (8) shall receive remuneration and other benefits as determined by the Ministry of Environment while performing their duties.
